EB-5 to continue operating despite shutdown

USCIS has clarified today that EB-5 will continue to operate, despite the lapse in funding (shutdown).

The EB-5 Program will continue to operate, except EB-5 regional center program. EB-5 regional center is an economic unit, public or private, in the United States that is involved with promoting economic growth. Regional centers are designated by USCIS for participation in the Immigrant Investor Program.

Here are some notable announcements made by USCIS regarding EB-5

  • USCIS will not accept new Forms I-924, Application for Regional Center Designation Under the Immigrant Investor Program, as of Dec. 21, 2018.
  • Pending Forms I-924 as of Dec. 21, 2018, will be put on hold until further notice.
  • Regional center-affiliated Forms I-526 and I-485 after Dec 22 will be put on hold for an undetermined length of time.
  • All Forms I-829, Petition by Entrepreneur to Remove Conditions on Permanent Resident Status, filed before or after the expiration date, will not be affected by the expiration of the program.

 

USCIS will provide further guidance to the public if legislation is enacted to reauthorize, extend, or amend the regional center  program. USCIS offices will be open and will continue to accept petitions and applications for benefit requests
